Coal mining primacy

Today, Tennessee is the only state that actively mines coal that does not oversee its own regulatory program. Instead, Tennessee is regulated by the Office of Surface Mining, Reclamation and Enforcement (OSM). 

The Tennessee Mining Association believes that in keeping in line with the Surface Mining Control and Reclamation Act's  intent, as expressed in Section 101 (f), state oversight should be returned to Tennessee. This state oversight is known as "primacy." Legislation introduced in the 109th General Assembly will begin the process of returning primacy to Tennessee.
